Privacy Policy

Your privacy is critically important to us. At Majembu, we have a few fundamental principles:

• We are thoughtful about the personal information we ask you to provide and the personal information that we collect about you through the operation of our services.

1. Information We Collect

To provide and improve Majembu, we collect the following types of information:

• Account Information: When you create a Majembu account, we collect your name, and optionally your age, gender, and a description you provide. Your email address is collected for account management, communication, and if you opt for premium services.
• Conversation Data: This includes:
  • Contact Information (`person`): Information about the individuals you are messaging, which you provide.
  • Interaction Details: Relationship type, current communication goals, perceived emotions, and interaction scores you might input or that are derived to assist you.
  • Conversation Logs (`conversation_log`): The content of messages drafted and sent via Majembu, and potentially received messages if you connect this functionality. This data is essential for the AI to assist you and for you to review past interactions.
  • Reply delay settings and last seen information related to your conversations.
• AI Interaction Data: Prompts you provide to the AI and the suggestions it generates. This is used to refine the AI's assistance for you.
• Usage Information: We collect information about your usage of Majembu, such as `messages_per_day`, features accessed, and your selected `premium_tier`.

2. How We Use Your Information

We use the information we collect for the following purposes:

• To Provide and Maintain the Service: To operate Majembu, allow you to send messages, and use AI assistance.
• To Personalize Your Experience: To tailor AI suggestions and features based on your input and conversation history.
• To Improve Our Service: To understand how users interact with Majembu, identify areas for improvement, and develop new features. This includes analyzing anonymized or aggregated data.
• To Communicate With You: To send you service-related updates, security alerts, support messages, and information about your account or new features (you can opt-out of promotional communications).
• For Security and Fraud Prevention: To protect our users, our service, and to comply with legal obligations.
• AI Model Processing: Your conversation data (prompts, context) is sent to our AI model Majembu_OOO to generate message suggestions. We aim to ensure you that we have a strong privacy practices.

3. How We Share Your Information

We do not share your personal information with third parties except in the limited circumstances described below:

• With Your Consent: We may share information with your explicit consent.
• Messaging Platforms: Information is inherently shared with Instagram (and soon WhatsApp) when you use Majembu to send messages through these platforms. Your use of these platforms is also subject to their respective privacy policies and terms of service.
• Legal Requirements: We may disclose your information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is reasonably necessary to protect our property or rights, or the safety of the public or any person.
• Business Transfers: In connection with any merger, sale of company assets, or acquisition of all or a portion of our business by another company, user information would likely be one of the assets that is transferred or acquired by a third party.

4. Data Security

We take reasonable measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. This includes using encryption for data at rest and in transit where appropriate, and secure access controls. The `API_KEY` values in our `apikey` table (used by Majembu to access AI services) are stored securely. Your user-specific `API_KEY` (if implemented for you to access Majembu programmatically) should be kept confidential by you.

However, no internet-based service can be 100% secure, so we cannot guarantee absolute security. We are committed to transparency.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the services. Active `conversation` data is kept for ongoing use. `conversation_archive` data is kept for your reference. We may also retain certain information for legitimate business purposes, such as to resolve disputes, enforce our agreements, or comply with legal obligations.

6. Your Rights

Depending on your location, you may have certain rights regarding your personal information, including:

• The right to access the personal information we hold about you.
• The right to request correction of inaccurate personal information.
• The right to request deletion of your personal information (subject to certain exceptions).
• The right to object to or restrict certain processing of your personal information.

7. Children's Privacy

Majembu is not intended for use by children under the age of 13 (or a higher age threshold depending on your jurisdiction). We do not knowingly collect personal information from children under this age. If we become aware that we have collected personal information from a child under this age, we will take steps to delete such information.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email (if we have your address) or by posting a notice on our service prior to the change becoming effective. We encourage you to review this Privacy Policy periodically.

Terms of Service

1. Acceptance of Terms

By accessing or using Majembu ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, do not use the Service.

2. Service Description

Majembu is an AI-powered bot designed to help you message people you personally know directly through your Instagram inbox—and soon, WhatsApp. It offers AI assistance for composing personalized messages.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials for Majembu and for the third-party platforms (Instagram, WhatsApp) you connect.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate and complete information when creating your account and to keep this information up to date.

4. User Responsibilities and Conduct

• You agree to use Majembu only for lawful purposes and in accordance with these Terms.
• You are solely responsible for the content of the messages you send using Majembu and for your interactions with others.
• You must comply with the terms of service of any third-party platform (e.g., Instagram, WhatsApp) that you use in conjunction with Majembu. Violation of third-party platform terms may result in suspension or termination of your Majembu access and could impact your accounts on those platforms.
• You agree not to use Majembu to:
  • Send spam, unsolicited messages, or engage in harassment.
  • Violate any applicable laws or regulations.
  • Impersonate any person or entity.
  • Transmit any viruses, worms, or malicious code.
  • Attempt to gain unauthorized access to our systems or other users' accounts.

5. AI-Generated Content

• Majembu uses artificial intelligence to assist in composing messages. While we strive for helpful and appropriate suggestions, AI-generated content may not always be accurate, complete, or suitable for every situation.
• Majembu and its creators are not liable for any consequences arising from the use of AI-generated content.

6. Subscriptions and Payments

• Majembu may offer different subscription tiers (`Free`, `Diamond`, `Gold`, `Silver`). Features and `messages_per_day` limits may vary by tier.
• If you choose a paid tier, you agree to pay the applicable fees. Payment terms will be presented at the time of purchase.

7. Intellectual Property

• The Majembu Service, its visual design, features, and underlying code (excluding third-party components and open-source libraries) are the property of its licensors and are protected by copyright and other intellectual property laws.

8. Termination

• You may stop using the Service and terminate your account at any time.
• We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or for any other reason.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MAJEMBU OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
